1. General
- These Terms and Conditions apply to all offers, agreements and services provided by Every Day Wonder and Every Day Tango, hereinafter referred to as “the Business”.
- Every Day Wonder and Every Day Tango are activities and trading names operated by the same business.
- These Terms and Conditions apply to both private and business customers, unless otherwise agreed in writing.
- By booking, registering for, ordering or purchasing a service or product, the customer agrees to these Terms and Conditions.
- The specific information provided for an activity, such as the date, time, location, duration, content and price, forms part of the agreement.
- If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in force. The parties will seek to replace the invalid provision with a valid provision that reflects its original intention as closely as possible.
2. Offers and Agreements
- An agreement is concluded when the customer registers, makes a booking, places an order or otherwise accepts the offer made by the Business.
- The offer will clearly state, where applicable, what the service or activity involves, where and when it takes place and what the costs are.
- Obvious errors or mistakes in an offer do not bind the Business.
- The Business reserves the right to cancel or modify an activity where there are reasonable grounds to do so, for example due to illness, insufficient registrations, circumstances affecting the availability of the venue or other circumstances beyond the Business's reasonable control.
- If an activity is cancelled by the Business, the Business will offer an appropriate solution, such as rescheduling the activity or refunding the amount paid for the cancelled activity, where applicable.
3. Prices and Payment
- The applicable price is stated in the relevant offer or agreed upon with the customer in advance.
- Payment must be made in the manner and within the period specified in the offer or booking confirmation.
- If payment is not made on time, the Business may, where legally permitted, suspend participation or delivery until payment has been received.
- Any costs arising from late payment may be charged to the customer to the extent permitted by law.
- The Business may change its prices for future activities. A price that has already been agreed as part of an existing agreement will not be changed unilaterally on this basis.
4. Cancellation and Withdrawal by the Customer
4.1 General
- Any cancellation must be communicated in writing or by email.
- Specific cancellation conditions may apply to individual activities. If so, these conditions will be communicated before booking and form part of the agreement.
- Any statutory right of withdrawal applicable to the customer remains unaffected by these Terms and Conditions.
- Where a statutory right of withdrawal does not apply, the cancellation conditions stated for the relevant activity will apply.
4.2 Tango Courses
- Registration for a Tango course reserves a place for the participant for the entire course period.
- Once a registration has been confirmed, the participant cannot cancel the course, except where a statutory right of withdrawal or another mandatory legal right applies.
- The Business plans and commits to the course based on the number of registrations received. For this reason, a participant who chooses not to attend individual lessons is not entitled to a refund or reduction of the course fee.
- A participant may make up one missed lesson during the course period, subject to availability and in consultation with the Business.
- In the event of illness, the participant may contact the Business to discuss an appropriate solution. The Business will consider the circumstances and, where reasonably possible, offer a suitable solution.
- A missed lesson beyond the one permitted make-up lesson does not create an automatic right to a refund or compensation.
4.3 Private Tango Lessons
- A private lesson may be cancelled or rescheduled free of charge if this is communicated at least 24 hours before the scheduled start time.
- If a private lesson is cancelled less than 24 hours before the scheduled start time, or if the participant does not attend, the full lesson fee may be charged.
- The Business may make an exception in special circumstances.
5. Workshops, Events and Activities
- Specific participation and cancellation conditions may apply to workshops, events and other activities.
- The customer is responsible for arriving at the specified location on time and for checking any practical information provided before the activity.
- Participation in activities is at the participant's own responsibility.
- Participants must follow reasonable instructions given by the Business or its instructors regarding safety and the proper conduct of the activity.
- If a participant's behaviour seriously disrupts the safety, wellbeing or enjoyment of other participants, the Business may exclude that participant from further participation. Where the exclusion results from the participant's own behaviour, no refund will normally be due, to the extent permitted by law.
6. Every Day Wonder Retreats and Multi-Day Activities
- Every Day Wonder may organise retreats and multi-day activities that include accommodation and a programme of activities.
- The specific offer will state which elements are included in the price, such as accommodation, meals, workshops or other activities.
- Participants are responsible for arranging and paying for their own travel to and from the retreat location, unless explicitly stated otherwise in the offer.
- Where accommodation or other services are provided by an external provider, additional terms and conditions of that provider may apply.
- The Business will communicate clearly which services are provided directly by the Business and which are provided by third parties.
- Depending on the exact structure of a retreat, mandatory rules relating to package travel or linked travel arrangements may apply. Where such rules apply, the Business will comply with the applicable legal requirements.
- Participation in an Every Day Wonder retreat does not constitute medical, psychological or other professional healthcare or treatment.
- Participants remain responsible for their own decisions, boundaries and participation in activities.
7. Health and Physical Activities
- Some activities offered by Every Day Wonder and Every Day Tango involve physical activity, movement or dance.
- Participants are responsible for determining whether participation is appropriate for their own physical condition and circumstances.
- Participants should inform the Business of any relevant physical limitations or circumstances that may reasonably affect safe participation.
- The Business does not provide medical diagnosis or treatment and cannot be held responsible for injury or complaints arising from participation, except where the Business is legally liable.
8. Liability
- The Business will perform its services with reasonable care and to the best of its ability.
- The Business is liable for direct damage only to the extent that such damage results from an attributable failure to perform the agreement or unlawful conduct and insofar as such liability cannot legally be excluded or limited.
- The Business is not liable for damage resulting from incorrect or incomplete information provided by the participant or from failure to follow reasonable instructions.
- The Business is not responsible for loss, theft or damage to personal belongings during activities, unless legally liable for such loss, theft or damage.
- Any limitation of liability in these Terms and Conditions does not apply where liability cannot legally be excluded or limited.
9. Force Majeure
- The Business is not required to fulfil an obligation where it is prevented from doing so by circumstances beyond its reasonable control.
- Such circumstances may include illness, accident, extreme weather conditions, government measures, fire, technical failures, venue-related problems or other circumstances beyond the reasonable control of the Business.
- If an activity cannot take place due to force majeure, the Business will make reasonable efforts to offer an appropriate solution, such as rescheduling the activity or providing a refund where appropriate and legally required.
10. Personal Belongings
Participants remain responsible for their personal belongings brought to activities. The Business recommends that valuable belongings are not left unattended.
11. Photography and Video
- Photographs and/or video recordings may be made during activities for communication and promotional purposes.
- The Business will not use recognisable images of participants for promotional purposes where specific consent is legally required without obtaining that consent.
- Where explicit consent is requested for the recognisable use of image material, participants may refuse or, where reasonably possible, withdraw their consent for future use.
- Participants may not commercially use photographs or video recordings of other participants without the necessary permission.
12. Intellectual Property
- All texts, exercises, programmes, teaching materials, photographs, videos, presentations, concepts and other materials developed or provided by Every Day Wonder or Every Day Tango remain the property of the Business or the relevant rights holder.
- Such materials may not be copied, distributed, published, commercially used or presented as the participant's own work without prior written permission.
- Personal use of materials provided by the Business is permitted unless otherwise stated.
13. Privacy
- The Business processes personal data only to the extent necessary for the performance of agreements, communication, administration and other legitimate purposes.
- The Business's Privacy Policy applies to the processing of personal data.
- Personal data will not be shared with third parties unless this is necessary for the performance of the agreement, required by law or permitted on another lawful basis.
14. Complaints
- Complaints concerning an activity, service or product should be communicated to the Business in writing as soon as reasonably possible after the issue has been discovered.
- The Business will consider complaints carefully and will make reasonable efforts to reach an appropriate solution with the customer.
- A complaint does not automatically suspend the customer's payment obligation.
15. Changes to Activities
- The Business may make reasonable practical changes to an activity where necessary, for example due to venue availability, safety considerations or circumstances beyond its control.
- The Business will make reasonable efforts to maintain the nature and quality of the activity.
- If a change constitutes a material deviation from what was agreed, the customer will have the rights provided by applicable law.
16. Changes to These Terms and Conditions
- The Business may amend these Terms and Conditions where there is a legitimate reason to do so, including changes in legislation or the Business's services.
- Amendments will not apply retroactively to existing agreements where this is not legally permitted.
- Where legally required, customers will be informed of material changes in a timely manner.
17. Applicable Law and Disputes
- All agreements between the Business and the customer are governed by Dutch law.
- Where the customer is a consumer, mandatory consumer protection provisions applicable to the customer remain unaffected.
- The parties will first attempt to resolve any dispute amicably.
- If a dispute cannot be resolved amicably, it may be submitted to the competent court in accordance with applicable Dutch law.
